Introduction
These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," "your") and EasyMenus ("we," "our," "us") governing your access to and use of the EasyMenus Platform, including our website, applications, and services related to menu hosting, publishing, analytics, and integrations.
By using the EasyMenus Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Platform immediately.
1. Eligibility
- You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Platform.
- Accounts created for businesses must be authorised by the owner or an authorised representative.
- You represent and warrant that you have the authority to enter into these Terms on behalf of the business you represent.
2. Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You are liable for all activities conducted under your account.
- You must notify EasyMenus immediately if you suspect unauthorised access.
- You may delete your account at any time via Settings. Deletion is permanent and removes all associated data within 30 days.
3. Subscription Plans & Billing
EasyMenus offers the following plans:
- Free: 1 menu, 150 themes, 1 daily special, EasyMenus badge displayed. No credit card required.
- Standard (C$25/month): 3 menus, no branding, analytics, custom domain, custom QR codes.
- Professional (C$45/month): 8 menus, 21 languages, allergen management, AI photos, unlimited specials, staff notes.
Plans are billed monthly or annually (20% discount for annual). All payments are processed via Stripe. EasyMenus does not store full credit card details. Free trials of 7 days are offered on paid plans β no credit card required.
Cancellations
- You may cancel at any time through your account Settings or Subscription page.
- Your plan remains active until the end of the current billing cycle.
- No partial refunds are provided unless required by law.
- Published menus remain accessible after cancellation (they are not unpublished).
Upgrades & Downgrades
- Upgrading takes effect immediately. Prorated charges may apply.
- Downgrades apply at the start of the next billing cycle.
- Features unlocked via ingredient credits (languages, themes, custom domain, badge removal) remain permanently unlocked regardless of plan changes.
Refunds
- All sales are final. Subscription fees and prepaid pack purchases are non-refundable for periods already started or packs already activated.
- If you believe you were charged in error, contact hello@easymenus.net within 14 days of the charge.
- Refund requests are reviewed on a case-by-case basis at our sole discretion.
- Chargebacks filed without first contacting us may result in account suspension.
- Free trial periods do not incur charges. You will not be billed unless you explicitly choose a paid plan.
Prepaid Packs
- Prepaid access packs (weekly, 1-month, 3-month, 6-month) are one-time Stripe payments that activate immediately.
- Prepaid packs are non-refundable once activated.
- When a prepaid pack expires, your account reverts to the Free plan. Published menus remain live, but paid-tier features (analytics, custom domain routing, additional languages, staff notes) revert to free-tier limits.
- Features permanently unlocked via ingredient credits are not affected by prepaid expiry.
- Prepaid packs do not auto-renew.
4. Ingredient Credits
EasyMenus uses an engagement system called "Ingredients" (π§). Credits are earned by completing actions (adding items, publishing menus, etc.) and can be spent on features.
- Ingredient credits have no cash value and are non-refundable.
- Credits earned through achievements are permanent and do not expire.
- Features unlocked via credits (e.g., language unlocks, premium themes, custom domain access, badge removal) are permanent and survive plan changes, cancellations, and downgrades.
- Prepaid plan access packs (granting time-limited Standard or Professional features) may be purchased via Stripe as one-time payments.
- EasyMenus reserves the right to adjust credit costs and earning rates with reasonable notice.
5. Services Provided
EasyMenus provides tools to:
- Build and publish digital menus with themes, categories, and items.
- Host menus on EasyMenus subdomains or custom domains.
- Upload restaurant images, logos, header backgrounds, and branding materials.
- Access menu analytics (views, clicks, device and language breakdown).
- Generate and customise QR codes linking to menus.
- Generate AI-powered dish photos and custom themes.
- Translate menus into multiple languages.
- Manage staff access with PIN-protected staff views.
Services vary by subscription tier. Some features are accessible via ingredient credits on the Free plan.
6. User Content
- You retain ownership of the content you upload (menus, photos, logos, descriptions).
- By uploading, you grant EasyMenus a worldwide, non-exclusive licence to host, display, and deliver your content for the purpose of operating the Platform.
- You represent and warrant that you have all rights necessary to upload such content.
- You may not upload unlawful, offensive, or infringing content.
- You may export all your data at any time via Settings β "Download My Data".
7. AI-Generated Content
- EasyMenus offers AI-powered features including dish photo generation, custom theme creation, menu translations, and description rewrites.
- AI-generated content is provided "as-is" without warranties of accuracy, originality, or fitness for a particular purpose.
- AI-generated dish photos are illustrative and may not accurately represent your actual dishes. You are responsible for reviewing all AI outputs before publishing.
- AI translations are machine-generated and may contain errors. You are responsible for verifying translations, especially for allergen and dietary information.
- EasyMenus is not liable for any claims, damages, or losses arising from the use of AI-generated content on your published menus.
8. Allergen Information Disclaimer
- EasyMenus provides allergen management tools for informational purposes to help restaurants communicate allergen data to their customers.
- Restaurant owners are solely and entirely responsible for the accuracy, completeness, and currency of all allergen information displayed on their menus.
- EasyMenus does not independently verify, audit, or guarantee the accuracy of any allergen data entered by users.
- EasyMenus is not liable for allergic reactions, health consequences, regulatory penalties, or any other damages resulting from inaccurate, incomplete, or outdated allergen information published through the Platform.
- If you are a diner with food allergies, always confirm allergen information directly with the restaurant before ordering.
9. Acceptable Use
You agree not to:
- Use the Platform for illegal, fraudulent, or harmful purposes.
- Misrepresent your identity or affiliation.
- Interfere with the security or proper functioning of the Platform.
- Attempt to access restricted parts of the Platform without authorisation.
- Create automated accounts or use bots to abuse the achievement/credit system.
- Flood the Platform with excessive API requests or event data.
10. Privacy & Data Protection
Your use of the Platform is also governed by our Privacy Policy. By using EasyMenus, you consent to the collection, use, and disclosure of your personal data as described in the Privacy Policy.
11. Intellectual Property
- The EasyMenus Platform, including design, code, trademarks, themes, and content (excluding user content), remains the property of EasyMenus or its licensors.
- The 150 menu themes are licensed for use within the Platform only and may not be extracted or redistributed.
- You may not copy, reproduce, modify, or distribute any part of the Platform without written permission.
12. Availability & Maintenance
- EasyMenus strives to provide continuous availability but does not guarantee uninterrupted service.
- Scheduled maintenance or technical issues may cause temporary downtime.
- EasyMenus is not liable for service interruptions beyond our reasonable control.
- Database backups are performed every 6 hours. We use commercially reasonable efforts to prevent data loss.
13. Limitation of Liability
To the fullest extent permitted by law:
- EasyMenus provides the Platform "as is" without warranties of any kind.
- EasyMenus is not responsible for lost profits, revenue, or data.
- Our total liability is limited to the amount paid by you in the past 12 months.
14. Indemnification
You agree to indemnify and hold harmless EasyMenus, its affiliates, officers, and employees from claims, damages, or expenses arising from:
- Your violation of these Terms.
- Your uploaded content.
- Your misuse of the Platform.
15. Termination
- EasyMenus may suspend or terminate your account at any time, for any reason, at our sole discretion. This includes but is not limited to breach of these Terms, non-payment, abuse of the Platform, or any conduct we deem harmful to the Platform or its users.
- EasyMenus is not required to provide a reason for account suspension or termination, and is under no obligation to reinstate a terminated account.
- Upon termination, your access will be disabled. You have 30 days to export your data before it is permanently deleted.
- You may delete your own account at any time via Settings. Stripe subscriptions are cancelled automatically.
- No refund will be issued for the remaining portion of any active subscription or prepaid pack upon termination for cause.
- Certain provisions (ownership, liability limits, indemnification) survive termination.
16. Changes to Terms
EasyMenus may update these Terms periodically. Continued use after changes indicates acceptance. If required by law, we will provide notice and seek your consent for material updates. Changes will be posted with a new Effective Date.
17. Governing Law
These Terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the courts located in Vancouver, British Columbia.
